1. Acceptance of Terms

These Terms govern your use of NodlBit Wallet, a mobile application designed to allow you to manage Bitcoin wallets and transactions securely on your device. We may update these Terms from time to time, and the updated version will be posted within the App with a revised “Last Updated” date. Continued use of the App after such changes constitutes your acceptance of the updated Terms.

2. Description of the App

NodlBit Wallet is a non-custodial Bitcoin wallet application that enables you to generate, store, and manage Bitcoin wallet addresses and private keys directly on your device. We do not control or custody your Bitcoin or any associated data. All wallet data is stored locally on your device, and you are solely responsible for its security.

3. Eligibility

The App is available for use by individuals of all ages and jurisdictions, provided such use complies with applicable local laws. By using the App, you represent that your use does not violate any laws or regulations in your jurisdiction.

4. User Responsibilities

As a User, you agree to:

• Secure Your Device: Safeguard your device, private keys, and any backups. We are not responsible for any loss of funds or data due to lost, stolen, or compromised devices or keys.
• Legal Use: Use the App only for lawful purposes and in compliance with all applicable local, national, and international laws, including those related to cryptocurrency.
• No Reverse Engineering: Not attempt to reverse-engineer, decompile, or modify the App, except as permitted by applicable law.
• Risk Acknowledgment: Understand and accept the risks associated with cryptocurrency, including price volatility, hacking, and loss of access to funds.

5. Our Responsibilities and Limitations

• Non-Custodial Nature: We do not have access to your private keys, Bitcoin funds, or transaction data. We cannot recover lost keys or funds on your behalf.
• No Warranties: The App is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose or uninterrupted operation. Cryptocurrency transactions are irreversible, and we are not liable for errors you make in using the App.
• No Third-Party Dependencies: The App does not rely on third-party services for its core functionality. Any interaction with external tools (e.g., blockchain networks) is beyond our control.

6. Intellectual Property

The App, including its design, code, and branding, is owned by KOMATI FOUNDATION and protected by copyright, trademark, and other intellectual property laws. You are granted a non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

7. Prohibited Activities

You may not:

• Use the App for illegal activities, such as money laundering or fraud.
• Distribute malware or attempt to harm the App or other users.
• Copy, distribute, or sell the App or its components without our written permission.
• Use the App in a way that infringes on the rights of others or violates these Terms.

8. Termination

We reserve the right to terminate or suspend your access to the App at our sole discretion, without notice, if we believe you have violated these Terms or applicable law. You may stop using the App at any time by uninstalling it from your device.

9. Limitation of Liability

To the maximum extent permitted by law, KOMATI FOUNDATION, its affiliates, and employees shall not be liable for:

• Any direct, indirect, incidental, or consequential damages arising from your use of the App.
• Loss of Bitcoin or funds due to user error, device failure, hacking, or any other cause.
• Interruptions in service due to technical issues, blockchain network failures, or other factors beyond our control.

You use the App at your own risk, and we are not responsible for any financial losses or damages you may incur.

10. Indemnification

You agree to indemnify and hold KOMATI FOUNDATION harmless from any claims, losses, or damages (including legal fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of South Africa, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiation. If negotiations fail, disputes will be subject to the exclusive jurisdiction of the courts in South Africa.

12. No Financial Advice

The App is a tool for managing Bitcoin and does not provide financial, investment, or legal advice. You are solely responsible for your financial decisions and should consult professionals as needed.

13. Force Majeure

We are not liable for delays or failures in providing the App due to events beyond our control, such as natural disasters, government actions, or blockchain network issues.
